TreatyX Terms & Conditions of Use

1. Acceptance of Terms

Welcome to TreatyX ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the TreatyX website (TreatyX.org), mobile application, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

2. Eligibility

You must be at least 13 years of age to use our Services. If you are under 18, you may only use our Services with the consent and supervision of a parent or legal guardian. By using our Services, you represent and warrant that you meet these eligibility requirements.

3. Services Description

TreatyX provides an augmented reality platform that displays Indigenous treaty boundaries, traditional place names, and cultural stories. Our Services include:

  • A mobile application for iOS and Android devices

  • Educational content and mapping services

  • E-commerce platform for TreatyX merchandise

  • Community features and content sharing

  • Subscription services (where applicable)

4. User Accounts

4.1 Account Creation

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information

  • Maintain the security of your password

  • Notify us immediately of any unauthorized use

  • Accept responsibility for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct we deem inappropriate.

5. Acceptable Use

You agree not to use our Services to:

Given the sensitive nature of our content, you specifically agree not to:

  • Disrespect or mock cultural stories, languages, or traditions

  • Use content in ways that violate cultural protocols

  • Share sacred or restricted knowledge without permission

  • Use the Services to promote cultural appropriation

6. Intellectual Property Rights

6.1 Our Intellectual Property

All rights, title, and interest in the Services, including:

  • Software, code, and algorithms

  • AR technology and mapping systems

  • Website design and user interface

  • TreatyX trademarks and logos

  • Business methods and processes

...are owned by TreatyX and protected by Canadian and international intellectual property laws.

6.2 Indigenous Knowledge Protection

We recognize that:

  • Indigenous knowledge, stories, and languages featured in our Services remain the intellectual property of the originating communities and knowledge holders

  • TreatyX does not claim ownership over Indigenous cultural content

  • We serve as licensed stewards of this content under specific agreements with knowledge holders

6.3 Your Content

If you submit content to our Services:

  • You retain ownership of your content

  • You grant us a license to use, modify, and display your content

  • You represent you have the right to share the content

  • We may remove content that violates these Terms

7. Subscription and Payment Terms

7.1 Fees

Some features may require payment. You agree to:

  • Authorize us to charge your payment method

  • Accept that fees are non-refundable except as required by law

7.2 Automatic Renewal

Subscriptions automatically renew unless cancelled. You may cancel at any time through your account settings.

8. Merchandise Purchases

We strive for accuracy but:

  • Product colors may vary from display

  • Sizing may differ by manufacturer

  • We reserve the right to modify products

  • Limited edition items are final sale

8.2 Shipping and Delivery

  • Shipping times are estimates only

  • Risk of loss transfers upon delivery

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, including:

  • Merchantability and fitness for a particular purpose

  • Accuracy, completeness, or reliability of content

  • Uninterrupted or error-free operation

  • Security or freedom from viruses

  • Compatibility with your device or network

10. Limitation of Liability

To the maximum extent permitted by law, TreatyX shall not be liable for:

  • Claims exceeding the amount you paid us

We specifically disclaim liability for:

  • Accuracy of historical or cultural information

  • Community disagreements about content

  • Changes to cultural protocols

  • Individual interpretations of Indigenous knowledge

10.3 Educational Purpose Acknowledgement

You acknowledge that:

  • Our Services are for educational purposes only

  • Content should not be used for legal, land claim, or treaty rights decisions

  • You should consult official sources for authoritative information

11. Indigenous Knowledge and Ethical Framework

11.1 Respect for Protocols

You agree to:

  • Respect cultural protocols associated with content

  • Use content only as intended and permitted

  • Not share restricted or sacred knowledge

  • Honor the wishes of knowledge holders

11.2 Ethical Use

You acknowledge and agree:

  • Our Indigenous Contributor Fund ensures fair compensation

  • 40% of relevant revenue supports knowledge holders

  • We operate under guidance from an Indigenous Advisory Council

  • You will use content in culturally appropriate ways

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Third-Party Links and Services

Our Services may contain links to third-party websites or services. We:

  • Are not responsible for third-party content

  • Do not endorse third-party services

  • Have no control over third-party practices

14. Termination

We may terminate or suspend your access to the Services:

  • Immediately for violations of these Terms

  • For prolonged inactivity

  • For any reason with 30 days' notice

  • Upon discontinuation of Services

16. Governing Law and Dispute Resolution

16.2 Dispute Resolution

Any disputes shall be resolved:

  • First through good faith negotiation

  • Then through mediation in Toronto, Ontario

  • Finally through binding arbitration in Toronto, Ontario

  • Each party bears its own costs

16.3 Class Action Waiver

You waive any right to participate in class actions against TreatyX.

17. Special Provisions for Indigenous Communities

17.1 Community Rights

Recognizing TreatyX's Indigenous-led nature:

  • Communities retain rights to their cultural contributions

  • Communities may request content modification or removal

  • Special licensing terms apply to community partnerships

17.2 Dispute Resolution for Communities

For disputes involving Indigenous communities:

  • We prioritize community-based resolution

  • We consult with our Indigenous Advisory Council

  • We respect community governance structures

18. General Provisions

18.1 Entire Agreement

These Terms constitute the entire agreement between you and TreatyX.

18.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

18.3 No Waiver

Our failure to enforce any right or provision shall not waive that right.

18.4 Assignment

You may not assign your rights under these Terms without our consent.

18.5 Force Majeure

We are not liable for delays beyond our reasonable control.
